Law prevents older children from suing over parents’ deaths

Julie McPherson figured it would be easy to punish those she believes caused her mother’s death. Hire a lawyer. Sue. Little did she know that her age (42) would scare off attorneys who initially indicated an interest in taking her case. According to Florida law, only spouses or children under 25 can file a lawsuit seeking damages for a wrongful death caused by medical malpractice. [more]

    My mother was diagnosed with a rare auto-immune disease in May 2007. The treatment for this disease was chemotherapy and steroids. The treatment lead to her death in (2400 pages) and ordered a complete autopsy. The autopsy was clear - she never had the disease she was treated for. I carried all her medical records and autopsy report to an attorney. After several weeks reviewing the materials the attorney informed me I deffinately had a good case. I have since learned that because I am a surviving child over the age of 25 years old, I have no rights to persue legal action. If the doctors had ran over her I would be able to sue. I do not feel this is a fair law at all. Furthermore, there will be nothing in this doctors public records. This law needs to be revisited.

    Correction to my previous post - Her death was in December 2007. Her medical records were 2400 pages.
