Jury clears OB-GYN of failing to diagnose breast cancer

After deliberating three-and-a-half hours a Madison County civil jury cleared a Maryville obstetrician-gynecologist of failing to diagnose breast cancer in a five day medical malpractice case.

Wendy Wiggins sued Tina Gingrich, M.D. was sued in 2004, claiming Gingrich negligently failed to obtain a complete history of her condition and family history during a Sept. 17, 2002, office visit. She also claimed Gingrich failed to recognize the severity of her presenting condition, failed to take appropriate follow-up action based upon the examination and failed to advise her of appropriate follow-up care on the presenting condition. Wiggins claimed her breast cancer went undiagnosed until June 2003.She claimed she experienced severe pain and suffering, disfigurement, lost time from work and became disabled. Wiggins also claimed she became liable for large sums of money in medical expenses. She also claimed that had she been diagnosed by Gingrich at the time of her visit in 2002, she would have been covered by a health insurance plan.

    This is one sided. She won this case because the patient did not get the ultrasound she told her to get! But that is not in your news release. This women also did not get the MRI her subsequent treater recommened after she was treated for the cancer. If patients don’t comply and they suffer the consequences and someone is sued but wins, why do you print a news release that hurts their reputation? I feel badly for this patient, but it was not the docs fault she was visiting here from England and didn’t bother to follow through with her care. That is what the jury found. She also lied multiple times on her insurence application after she found the lump and was seen, trying to keep them from finding out that she was and the ultrasound was recommended but she failed to comply! It is all in the court transcripts and can be obtained if you really want to send out the truth. It is liable to only print one side of a story and leave the audience with the impression that she should have lost. She won in Madison county with Judge Byron!, that is almost impossible. Please remove this. Or, concentrate on the doctor winning in Madison County, which really is news worthy. We already have a hard time keeping docs here. Don’t chase the few good ones we have away!
